These Terms and Conditions (“Terms”) govern your use of DesktopBuddy software and services provided by
Cynical Software Ltd.
By creating an account, downloading, installing, or using DesktopBuddy, you agree to these Terms.
If you do not agree to these Terms, you must not use the service.

2. Description of the Service
DesktopBuddy is a downloadable Windows desktop software application that uses artificial intelligence to assist users
with tasks on their computer.
Features may include:
- Screen understanding through temporary screenshot analysis
- AI-powered assistance and responses
- Desktop guidance and task automation
- Personalised user experience across multiple devices
DesktopBuddy operates on a credit-based system where certain actions consume credits depending on the task and AI
model used.
3. User Accounts
To use DesktopBuddy you must create an account through the DesktopBuddy website.
Accounts are managed through the website and authenticated through WordPress login systems.
You are responsible for:
- Maintaining the security of your account
- Ensuring your login credentials remain confidential
- All activities that occur under your account
You must notify us immediately if you suspect unauthorised access.
4. Subscriptions and Credits
DesktopBuddy offers the following plans:
Free Tier – includes 100 credits
Smart Buddy Plan – subscription plan
Power Buddy Plan – subscription plan
Paid subscriptions are billed monthly.
Subscriptions may be cancelled at any time. Cancellation will take effect at the end of the current billing period.
Unused subscription time will not typically be refunded.
5. Credit Usage
Credits are used to process AI requests within DesktopBuddy.
Credit consumption depends on:
- The AI model used
- The size or complexity of the request
- The amount of processing required
Additional credit packages may be purchased through the DesktopBuddy website.
Credits are non-refundable.
6. Payments
Payments for subscriptions and credit purchases are processed through:
Stripe
WooCommerce
DesktopBuddy does not store full payment card details.
All payment processing is handled by the payment provider.
7. Refund Policy
Refunds are considered case-by-case.
In most circumstances, subscription payments and credit purchases are non-refundable.
8. AI Processing and Screen Analysis
DesktopBuddy may capture temporary screenshots when processing certain requests.
These screenshots are sent to third-party AI providers for analysis, which may include providers such as:
OpenAI
Google
Anthropic
Screenshots are processed solely to provide the requested assistance.
DesktopBuddy does not store screenshots on its servers.
Third-party AI providers process data according to their own privacy policies.
9. Desktop Interaction Permissions
DesktopBuddy may perform actions on your computer in order to assist with requested tasks.
These actions may include:
- Clicking interface elements
- Typing text
- Opening or interacting with applications
- Executing system or shell commands
- Viewing system or application information necessary to complete a request
DesktopBuddy performs these actions only in response to user requests or according to permissions configured
within the application settings.
Users remain responsible for reviewing actions suggested or performed by DesktopBuddy.
Cynical Software Ltd is not responsible for system changes, configuration changes, or actions taken as a result of
instructions provided to DesktopBuddy.
10. Acceptable Use
You agree not to use DesktopBuddy for:
- Illegal activities
- Distribution of unlawful material
- Pornographic or explicit content
- Harassment or abusive behaviour
- Activities that violate applicable laws
Automation activities, including bot usage and automation workflows, are permitted provided they comply with applicable laws.
11. Artificial Intelligence Disclaimer
DesktopBuddy uses artificial intelligence systems to generate responses and perform certain actions.
AI-generated output may:
- Contain errors
- Be incomplete
- Misinterpret information
Users are responsible for reviewing information and actions before relying on them.
DesktopBuddy should be used as a support tool and not as a replacement for professional advice or human judgement.
12. Service Availability
We aim to maintain reliable service availability but do not guarantee uninterrupted access.
The service may be modified, suspended, or discontinued at any time.
13. Limitation of Liability
To the maximum extent permitted by law, Cynical Software Ltd shall not be liable for:
- Loss of data
- Loss of profits
- Business interruption
- Indirect or consequential damages
Your use of DesktopBuddy is at your own risk.
14. Termination
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
Users may stop using DesktopBuddy at any time by cancelling their subscription and uninstalling the software.
15. Governing Law
These Terms are governed by the laws of Scotland, United Kingdom.
Any disputes will be subject to the jurisdiction of the Scottish courts.
